Ireland

In Ireland, a business can opt out of your email under regulation 13(4).

Irish law splits email by who receives it. An individual must consent, an address used mainly for work is outside that rule, and a business that has said no cannot be emailed. Automated calls and mobile marketing calls need the subscriber's consent. Sources and dates are below.

The rules that matter here

Marketing email, texts and calls

  • S.I. 336/2011 regulation 13: you may not send unsolicited direct-marketing email, or use an automated calling machine or fax, to an individual (natural person) unless they have notified you that they consent.[1]
  • Regulation 13(2): marketing email to an address that reasonably appears to be used mainly in the person's commercial or official activity, where the message relates solely to that activity, is outside the individual-consent rule in paragraph (1).[1] Note: Paragraph (2) is expressed 'subject to paragraph (4)'; read both.
  • Regulation 13(4): you may not send unsolicited direct-marketing email to a business or other non-natural-person subscriber that has notified you it does not consent.[1]
  • Regulation 13(6): unsolicited marketing calls or automated calls to a mobile phone need the subscriber's notified consent, or consent recorded in the National Directory Database.[1]

Personal data

  • As retrieved, India is not on the European Commission's list of countries with an EU adequacy decision. Moving personal data from the EU to a country without one needs another tool, and Standard Contractual Clauses are the common choice.[2]
  • The Commission describes Standard Contractual Clauses, modernized in June 2021, as pre-approved model contracts for transfers from EU/EEA controllers or processors to recipients in countries without an adequacy decision.[3]

Billing across borders

  • For supplies of services between businesses, the European Commission says the place of taxation is where the customer is established (Article 44 of the VAT Directive).[4] Note: Confirms the place-of-supply rule only. How the Irish customer accounts for the VAT is not published here; ask an adviser.

Time zone and language

Ireland keeps the same time as the UK, ahead of US Eastern time. Languages: English, Irish. Our own context, not a sourced rule.

What buyers here ask

Is it a problem that your company is in India and my customers are in the EU?

It means a data-transfer tool is needed. The European Commission's adequacy list does not include India, and it describes Standard Contractual Clauses as the common route. There is no processing agreement on file; a person will confirm whether we can sign one, and on what terms. Get your own advice on the details.

Can the system email my leads?

Irish rules (S.I. 336/2011, regulation 13) require notified consent for marketing email to individuals, with a carve-out for addresses used mainly in a person's commercial or official activity where the message relates solely to it. A business that has notified you it does not consent cannot be emailed either. Automated calls and marketing calls to a mobile phone need the subscriber's notified consent, or consent recorded in the National Directory Database.

Will it send WhatsApp messages out of the blue?

No. WhatsApp's policy requires opt-in, and Gonzo uses only the official WhatsApp Business API.

Who accounts for VAT on your invoice?

For business-to-business services, the Commission puts the place of taxation where the customer is established. We do not give VAT advice on how you account for it; check with your accountant.
