Marketing email, texts and calls

  • CAN-SPAM applies to business-to-business email as well as consumer email. The FTC says the law makes no exception for B2B email.[1]
  • Commercial email must carry accurate From/To/Reply-To and routing information, a truthful subject line, a clear sign that it is an ad, and a valid postal address.[1]
  • Every commercial email must give an easy way to opt out, and the opt-out must be honored within 10 business days.[1]
  • Under the TCPA, calls and texts made with an autodialer, or calls that use an artificial or prerecorded voice, need the prior express consent of the person called unless an exemption applies. Marketing calls of this kind need prior express written consent.[2] Note: FCC 24-24 (adopted February 15, 2024), background and footnote 3, states the consent rule and the written-consent rule for advertising/telemarketing robocalls, citing 47 CFR 64.1200(a)(2) and (3).
  • The FCC ruled on February 2, 2024 (FCC 24-17) that the TCPA's 'artificial or prerecorded voice' rule covers current AI technologies that generate human voices, so AI-voice calls need the called party's prior express consent absent an emergency or exemption.[3]
  • The FCC adopted a rule in FCC 24-24 that callers must honor do-not-call and consent-revocation requests within a reasonable time not exceeding 10 business days of receipt.[2] Note: Some parts of this order had later effective dates; check the FCC page for the current in-force status before stating a date.

Can an automated system text or call my leads without getting me into trouble?

Only with the right consent. The FCC says calls and texts made with an autodialer, and calls with a prerecorded voice, need prior express consent, and that AI-generated voices count as artificial voices (FCC 24-17). Does the email rule apply if I only email other businesses?

Yes. The FTC states that CAN-SPAM makes no exception for business-to-business email. Accurate headers, a postal address, and a working opt-out are required.

How fast must an opt-out be honored?

For email, within 10 business days under CAN-SPAM. For calls and texts, the FCC's 2024 order sets an outer limit of 10 business days for honoring revocation, subject to the order's effective dates.

Is a vendor based in India a problem for me?

We have not found a US federal rule that stops a US business from buying software services from a foreign vendor. We have not researched US tax or withholding treatment, and we are not publishing a view on it. Ask your accountant.

Will it say it is an AI?

Yes, wherever a system speaks to your customers. For the outreach product, the AI disclosure is built into every first touch and cannot be switched off.
